Terms of Service
Terms and conditions for using Autoist.
Effective date: October 6, 2025
These Terms of Service govern your access to and use of Autoist websites, apps, APIs, and related services. By creating an account, installing the app, or using the service, you agree to these Terms.
1. Who we are
Autoist Inc. is a California company. We provide software that helps drivers organize vehicle information, surface recalls, compare listings, and manage documents. Autoist does not provide legal, financial, insurance, credit repair, or DMV services.
2. Eligibility and accounts
- You must be at least 18 and able to enter a contract.
- Provide accurate account information and keep it updated.
- You are responsible for all activity under your account and for keeping credentials secure.
3. Service scope and important disclaimers
- Information only. Autoist provides information and tools. Decisions are yours. Verify information before you act.
- Not a DMV provider. Autoist is not a DMV Business Partner and does not issue registrations, renewals, or titles. If we offer these through a partner, the partner’s terms apply.
- Recalls. Recall visibility is based on public data and VIN lookups. Only the official VIN check confirms an open recall for a specific vehicle. Recall remedies are provided by manufacturers at no charge under law.
- Values and comparables. Any value, price, or comparable is an estimate. It is not an appraisal or a guarantee.
- AI outputs. AI features can be wrong or incomplete. Always review sources and use judgment.
- Do not use while driving. Use the service only when it is safe and legal.
4. License to you
Autoist grants you a limited, revocable, non-exclusive, non-transferable license to use the service for personal use, subject to these Terms.
5. App store terms
If you downloaded the app from Apple or Google, you also agree to their standard terms. Apple and Google are third-party beneficiaries of these Terms for the app. They have no obligation to provide maintenance or support.
6. Your content
- You retain ownership of documents and information you upload.
- You grant Autoist a worldwide, non-exclusive license to host, process, and display your content to operate the service.
- You represent that you have all rights needed for the content you upload.
7. Feedback
If you send ideas or suggestions, you grant Autoist a perpetual, royalty-free license to use them without restriction.
8. Prohibited use
You will not:
- Violate law, including the Driver’s Privacy Protection Act.
- Try to access or use DMV data without a permissible purpose.
- Scrape, copy, or misuse the service or data.
- Reverse engineer, probe, or disrupt the service.
- Use the service for commercial resale without written approval.
- Upload malware or content that infringes rights, invades privacy, or is unlawful.
9. Third-party services and links
The service may show or link to third-party sites, listings, dealers, lenders, insurers, shops, or data sources. Autoist does not control third parties and is not responsible for their acts, content, or terms. If you engage with a third party, that relationship is between you and them.
10. Communications
By creating an account, you consent to receive service messages by email, in-app, or SMS. Message and data rates may apply. You can opt out of marketing messages. You cannot opt out of service or transactional messages needed to run your account.
11. Paid features and billing
If you buy a paid plan or a paid feature:
- You authorize us and our processor to charge your payment method.
- Subscriptions renew automatically each period until you cancel.
- You can cancel in the app store or in your account settings.
- Fees are nonrefundable unless the law requires a refund.
12. Privacy
Our Privacy Policy explains how we collect and use personal information. By using the service, you agree to the Privacy Policy.
13. Data sources and accuracy
Autoist may use public and licensed data sources, including NHTSA VIN recall data, manufacturer information, and market listings. Data can change or be unavailable. Autoist may limit features by state, provider terms, or law.
14. Beta or preview features
We may label features as Beta or Preview. These features are experimental and may change, stop working, or be removed.
15. Suspension and termination
We may suspend or terminate access if you violate these Terms, create risk or harm, or if we must do so by law. You can stop using the service at any time and can request account deletion.
16. Changes to the service or Terms
We may change the service or these Terms. If changes are material, we will provide notice. Continued use after the effective date means you accept the changes.
17. Warranties disclaimer
The service is provided “as is” and “as available.” Autoist disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Autoist does not warrant that the service will be accurate, error-free, or uninterrupted.
18. Limitation of liability
To the maximum extent allowed by law, Autoist will not be liable for indirect, incidental, consequential, special, or punitive damages. Autoist’s total liability for any claim is limited to the greater of one hundred dollars or the amount you paid to Autoist for the service in the twelve months before the claim.
19. Indemnification
You will defend and indemnify Autoist and its officers, directors, employees, and agents from claims, damages, losses, and costs arising from your content, your use of the service, or your violation of these Terms or law.
20. Dispute resolution, arbitration, and class waiver
- You and Autoist agree to resolve disputes through binding arbitration under the Federal Arbitration Act, except you may bring individual claims in small claims court.
- You and Autoist waive any right to a jury trial.
- You and Autoist may bring claims only in an individual capacity, not as a class or representative.
- You can opt out of arbitration within 30 days after you first accept these Terms by emailing legal@autoist.com with your name, the email tied to your account, and a clear statement that you opt out of arbitration.
Arbitration will be administered by AAA under its Consumer Arbitration Rules. Venue will be San Francisco County, California, unless AAA rules require otherwise. Each party pays its own fees and costs, subject to fee shifting under applicable law.
21. Governing law
California law governs these Terms, without regard to conflict of laws rules, except where preempted by federal law.
22. Export and sanctions
You will comply with export control and sanctions laws. You will not use the service in embargoed countries or for prohibited end uses.
